Another aspect of medical marijuana that needs to be considered when applying for a medical marijuana card is that you will also be subjected to the highest tier of DUI if you are pulled over.
DUI In PA
It is considered the highest rate DUI for driving under the influence of marijuana. Pa does not have any exception for people using medical marijuana. If a person who uses medical marijuana is pulled over for a traffic offense, such as speeding or failing to signal, and the officer can smell or otherwise show probable cause that the person may have marijuana in their system, they may conduct a field sobriety test and require a breathalyzer or blood draw. Remember, refusing the comply with a breathalyzer or blood test will automatically result in a loss of license for one year. If, based on the officers training and experience, they can show that the driver was driving impaired or that the driver had marijuana in their system (which metabolites may remain in the blood system for weeks), the driver may be charged with the highest tier DUI.
